akin to what erol said, does anyone remember when will smith sampled 'rock the casbah' in a hip-hop track? now THAT was a shame... dirty dirty shame...

I'm sure they were paid... there ARE intellectual property laws, you know, they'd kick his ass big time if he hadn't paid. maybe he didn't contact the songwriters themselves, but I'm sure he has talked to their publishers.

I heard the track and acknowledged that he was nodding towards what are probably some early hooks that he likes, influences I guess... It's clearly meant to be obvious, it's just Tiga's twist on things.

my favourite track with 'shame' in the title is Monie Love's It's a Shame (My Sister), closely followed by the Lethal Bizzle version that samples the same Stevie Wonder track. I've yet to hear the original though, but I got the Monie Love on ebay for about £3.

And there are some quite complex rules in relation to sampling, if samples of the original have been used.
I believe you don't even have to credit a sample if it's below a certain length, and also some weird get out in relation to the number of recordings made that include the sample.
I'm sure someone more knowledgeable can expand or correct me on this.

it depaends if the sample is part of the melody or a lyric from the song, so a sample of a drum hit or a atonal grunt wouldn't count. ie, like the 'Uh' in Kiss by Prince.

But I think the one about number of units pressed isn't so well known, but has been widely exploited by artists from smaller genres over the years.
Can't remember the exact figures, but if you don't make more than, let's say it's 1,000 copies of an album, then you don't have to acknowledge sample sources, there may be other criteria that apply in conjunction with this. But it's this type of loophole that is largely exploited by artists using extensive film samples or music samples without crediting the source.
I have read up a bit on this before, but can't remember the exact source or the detail.... :-(

I still fume about the Rolling Stones managing to get most of the Urban Hymns royalties by virtue of the fact a five second orchestral REVISION of one of their tracks was sampled on Bittersweet Symphony.
Grrrrrr

but somehow Bittersweet Symphony wouldn't have sounded the same if they'd left that bit out...

i think the powers that be determined that one by the fact the melody line followed the sample, and the lyrics also acknowledged the presence of the orchestra ('cos it's a bittersweet symphony..') thus meaning that the track began from the sample... yeah, its a bummer.

Grrrrrr
revirsions still pay full publishing royalties... the copyright's in the song, not the performance or recording. obviously it's cheaper though, as you don't pay mechaical copyright too....

It sent Nick McCabe into hospital, all that stress.
But the Rolling Stones didn't even write that particular melody....and yet how many blues riffs/lyrics did they steal in the 60s.
Oh well

And the Stones don't get the royalties at all... for some reason, Andrew Loog Oldham picks them up, or so I've heard.
It's a massively unjust world.

These two threads gave me so much inspiration to write about copyrights today (mp3 sharing and this one). I'd love to discuss about it but I'm a little bit busy at the mo, I'll have to leave it for another day. (I'll definitely write a thesis about it for my master's one day).
I was reading this website, worth checking:

wasn't it Andrew Loog Oldham who actually did the orchestral version of a stones track, that Verve sampled anyway, therefore it seems right that mick and keef aren't getting it.

mick and keef are getting it as they wrote the track, and the loog version is merely a cover, even with sampling issue, you pay a one off fee for the sample but publishing goes to the writer

don't know how long the sample was The Verve used - but I heard the original - that Andrew Oldham version and in fact it sounds almost the same to Bittersweet Symphony. It almost makes made me wonder they were allowed to call it "sample" and not "coverversion".
back to Tiga. Drexciya I wouldn't worry too much about this. Tiga is an icon in this little clubbing world but hardly a global popstar in a TOTP vein. I usually freak out about such inacuarcies myself but here it seems a total waste of energy. Looking at your username it seems you got a great taste in music (I love Drexciya!) - why waste energy on this? Why even care? It's Tiga, he's alwasy been a bit of a musical charlatan but always with this smile on his face that lets him get away with murder. I enjoy the occasional Tiga track (although I prefer his remixes) - every now and again i caught him DJing which was an okay experience and he does a good job as A&R for his own label. Really don't lose sweat over it, he's not going for world domination... ;) x
